Terms & Conditions of Sale

1.Application
This agreement applies to this sale, and all statements made by Equimore in brochures, leaflets, and adverts, on the Internet or verbally. No other terms and conditions shall apply unless confirmed by Equimore in writing. Placing your order means acceptance of this agreement.

2.Orders & Payment
Orders may be received by writing, Internet, telephone or fax and are only binding when Equimore receives payment of the goods ordered. Payment can be made by cheque, credit card or debit card only. Equimore reserves the right, by giving you notice at the time you place your order, to increase the price of the Products to reflect any increase in the cost to Equimore, which is due to any factor beyond its control. If Equimore has to pursue payment after delivery of the Products, the cost of recovery shall be payable by you.

3.Delivery
Equimore shall use reasonable endeavours to deliver the Products on the next business day following your order. However some areas of the UK may take up to 72 hours. Delivery will be made when you or your representative signs for the goods or, if agreed with Equimore, when the order is delivered to the premises given by you. Risk of the loss of the goods passes to you on delivery. Equimore shall not be liable for any cost or damage caused by late or non-delivery of the Products. Any delay in delivery of the Products shall not give you the right to reject the Products or cancel your order.

4.Acceptance
When you receive the Product you must inspect it for any defects or non-conformity within 3 working days and within that time inform Equimore of any problems who will, at their discretion, rectify the situation.
In line with your Consumer rights, you may cancel your purchase at any time within 7 working days of receipt without cause and receive a refund of the Price paid. To do this you must inform Equimore in writing and return the Products immediately, in the same condition you received them and at your own cost and risk. Any statutory Consumer rights are unaffected by this Agreement.

5.Warranty
Subject to the limitations on its liability set out in these Terms, Equimore warrants the Products will be free from defects up to the date noted on the Statutory Statement Label. Should the Product be defective within this period, Equimore will replace the Product or refund the original cost to you.

6.Liability
Equimore shall have no other liability to you save for death or personal injury arising from Equimore's negligence and liability arising under the Consumer Protection Act 1987 (which if proved is not excluded). Where the Products are sold to you as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all representations, warranties, conditions or any other terms express or implied written or oral by statute or common law or otherwise are excluded to the fullest extent permitted by law including but not limited to those regarding fitness for purpose, performance, use or merchantability.

7.Force Majeure
Equimore is not liable for delays in performance caused by circumstances beyond its reasonable control; examples include strikes, terrorist acts, war, supplier/transport/Production problems, governmental or regulatory action and natural disasters.

8.Data Protection
Information disclosed by you to Equimore may be kept, disclosed, recorded or used for the following purposes:

1. Making or obtaining any enquiries, searches and references including but not limited to credit references.

2. Administering your account

3. Advising you by letter, telephone or otherwise of our services or Products in which we believe you may be interested.

4. Conducting legitimate and responsible business interests.

9.Credit Card Security Online
All credit and debit card numbers are encrypted in the software when the order is placed using a strong encryption method. They are only decrypted after they reach Equimore and not held in any clear text on any web site.

10.Privacy Policy
Equimore does not disclose your information to third parties unless covered by any Data Protection requirement (see 8 above). The Equimore web site uses cookies only to keep track of your shopping cart.

11.Trademarks, Copyrights & Restrictions
Equimore web site and materials, including, but not limited to, images, illustrations, audio clips, video clips is the property of Equimore and are protected from unauthorised copying and dissemination by copyrights that are owned or licensed by Equimore and by copyright law, trademark law, international conventions and other intellectual property laws.

12.Jurisdiction
Scots law and the exclusive court jurisdiction of the Scottish courts will apply to this Agreement.

13.Definitions
You, the Customer - a person or company buying Products from Equimore
Consumer - a private person buying Products for private use.
Equimore (us, our) - the Product vendor as identified on your invoice and billing note.
Price - as stated in our literature or web site
Product - as described in our web site or literature
